Returns

Premade items may be eligible for return under the following conditions:

• Item must be unused, in original condition, and in original packaging

• Items returned without prior contact

Refunds

IMPORTANT: PLEASE READ THIS ENTIRE AGREEMENT CAREFULLY BEFORE PURCHASING ANY PRODUCTS OR BOOKING ANY SERVICES.

By accessing www.scovalentistudio.com, purchasing any products, booking photography services, or otherwise engaging with Scovalenti Studio (collectively “the Company,” “we,” “us,” or “our”), you (“Client,” “Customer,” or “you”) agree to be legally bound by these Terms of Service, Disclaimer, and Liability Agreement.

1. Voluntary Participation & Informed Consent All purchases, bookings, and interactions with Scovalenti Studio are strictly voluntary. You confirm that you are participating of your own free will, after having had the opportunity to review these terms. You acknowledge that no one at Scovalenti Studio has made any guarantees, promises, or representations that induced you to engage with us.

2. No Guarantees or Warranties We strive to provide excellent products and services. However, all items are handmade or human-created and may contain natural variations. Photography is an artistic process subject to lighting, weather, movement, and other variables. We make no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or that any product or service will meet your expectations, produce specific results, or be free from all imperfections. You accept these inherent risks.

3. Shipping & Third-Party Carriers All shipping is handled by third-party carriers. We are not responsible for any loss, damage, theft, delay, or misdelivery once packages leave our facility. Any claims must be filed directly with the carrier. We are not liable for shipping-related issues.

4. Photography Services – Full Liability Release & Waiver By booking a photography session you expressly agree to the following comprehensive release:

• Photography is a hands-off, observational service. We are present solely to document moments as they naturally unfold and do not assume any supervisory, custodial, or protective role.

• You (and all participants, including minors) are solely responsible for your own safety, actions, supervision of children, and personal property at all times.

• You irrevocably release, waive, and discharge Scovalenti Studio, Diana Lee, all family members, co-founders, photographers, agents, and affiliates from any and all liability for:

  • Any injury, illness, death, or accident

  • Damage to or loss of personal property

  • Any claims arising from on-location, studio, or event photography

  • Emotional distress, dissatisfaction with images, or any other alleged harm

• This release applies whether the incident occurs before, during, or after the session, on public or private property.

5. Supervision of Minors You agree that you (or another responsible adult) will provide constant supervision of all children during any session. We are not responsible for supervising or ensuring the safety of minors.

6. Right to Refuse or Cancel Services We reserve the absolute right, at our sole discretion and for any reason or no reason, to:

• Refuse any order or booking

• Cancel or reschedule any session at any time (before or during the session)

• Terminate the relationship if we believe there is a safety concern, incompatibility, risk to our team, or any other reason we deem necessary

7. Limitation of Liability To the fullest extent permitted by Pennsylvania law, our total liability to you for any claim shall not exceed the total amount actually paid by you to us for the specific product or service in question. We shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, data, goodwill, or emotional distress.

8. Indemnification You agree to indemnify, defend, and hold harmless Scovalenti Studio, its owners, family members, and affiliates from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

• Your actions or negligence

• Any breach of these terms by you

• Any injury or damage caused by you or participants in your session

9. No Professional Advice Our products and services are for artistic, commemorative, and personal enjoyment purposes only. They are not intended to provide medical, therapeutic, psychological, spiritual healing, or professional advice of any kind.

10. Intellectual Property All images, designs, and content created by Scovalenti Studio remain our intellectual property until full payment is received. We retain rights to use images for portfolio, marketing, and promotional purposes unless a specific written agreement states otherwise.

11. Governing Law & Jurisdiction These terms are governed exclusively by the laws of the Commonwealth of Pennsylvania. Any disputes shall be resolved exclusively in the state or federal courts located in Butler County, Pennsylvania. You waive any objection to venue or jurisdiction in these courts.

12. Severability If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

13. Changes to Terms We reserve the right to update these terms at any time. Your continued use of our website or services constitutes acceptance of the updated terms.

By making any purchase or booking any service, you confirm that you have read, understood, and voluntarily agree to ALL of the above terms.

This allows us to print, press, assemble, and quality-check each piece to meet our standards.

Packaging Details
